This is because, no matter how ownership is held in Texas, Title needs to be transferred to the right owner with a Deed recorded at the County Clerk’s office so that the property can officially belong to the rightful owner. Often this process must be taken to Court if proper planning is not done in time.

There are so many ways to transfer real properties outside of Probate, so your family is not wasting time, energy, and money in unnecessary  Court proceedings.

If you are only relying on a Will or think you will inherit that property just because your name is also on the Deed, or you are married to the owner, you need a better plan.
